Terms of Service

Welcome. These Terms of Service ("Terms") cover use of services provided by Sage Coastal (the "Service"). By signing up or using the Service, you agree to these Terms.

The Service

Sage Coastal builds and operates AI voice agents ("Sage") that answer phone calls on behalf of small business customers. We configure each Sage instance to a customer's specific business — services, hours, qualifying questions, escalation rules — and deliver structured lead summaries to the customer via email, SMS, and/or a Google Sheet of their choosing.

Eligibility

You must be at least 18 years old and authorized to enter into agreements on behalf of the business you represent.

Service term and pricing

The standard arrangement consists of two components:

Custom builds (unusual workflows, multilingual personas, calendar integrations, deeper PMS integrations) are quoted separately.

Third-party usage costs — OpenAI API charges for voice processing, Twilio charges for phone numbers and call/SMS, ElevenLabs for premium voices — are billed directly to you by those providers using your own accounts. We do not mark up usage. Typical small business volume runs $30–60 per month in third-party usage.

Cancellation

You may cancel at any time with 30 days' written notice. The pilot setup fee is non-refundable once the build begins. The monthly retainer is prorated for the final partial month if applicable. After cancellation, we will hand off any in-flight customer leads, disable the Sage instance, and remove your data from our systems within 30 days (except as required by law for tax / audit retention).

Acceptable use

You may not use the Service to: send unsolicited communications; impersonate other businesses; mislead callers about who they are speaking with beyond standard AI disclosure; engage in fraud; collect data outside the scope of legitimate service operation; or violate any applicable law. We may suspend or terminate the Service for violations.

AI limitations and disclaimers

Sage is an AI voice agent. While we configure her carefully and monitor her performance, AI systems can produce unexpected output. Sage may occasionally misunderstand a caller, mishear a name or number, miss context, or give a response that is not what we would prefer. We do our best to minimize this through prompt engineering, monitoring, and ongoing tuning, but we cannot guarantee perfect performance.

The Service is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of liability

To the maximum extent permitted by law, Sage Coastal's total liability for any claim arising out of or related to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.

Indemnification

You agree to indemnify and hold harmless Sage Coastal from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms will be resolved in the state or federal courts located in Orange County, California, and you consent to that jurisdiction.

Disputes

If you have a dispute, contact us first at hello@sagecoastal.com. We commit to making a good-faith effort to resolve it informally before any formal action. Most issues turn out to be communication or tracking issues that resolve in five minutes.

Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated to active customers by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
